Consumption of alcohol
An authorised officer to require an individual within a ‘restricted area’ to stop drinking alcohol (or anything reasonably believed to be alcohol) where the individual is causing or is likely to cause nuisance or annoyance.
An authorised officer may confiscate alcohol where they believe the individual has or will likely act in an anti-social manner.
The order does not make it an offence to drink alcohol in a public place.
Other Intoxicating substances
Individuals must not, without a reasonable excuse, possess, or ingest, inhale, inject, smoke or otherwise use intoxicating substances, including the use of legal highs, which have the capacity to stimulate or depress the central nervous system.
What are the penalties for breaching a PSPO?
A breach of the PSPO could result in the issuing of a Fixed Penalty Notice (FPN) of a minimum of £100 payable within 14 days.
