Action taken following persistent failures

On 11th December 2017, at Warwick Crown Court, Mr Kayes Miah the business operator of Mr India at 54 West Street, Warwick received a custodial sentence and was banned from being involved in the management of any food business for persistent failure to take appropriate action to control rat and mouse infestation in his restaurant.

Mr Miah had previously pleaded guilty to 22 hygiene offences following three visits to his premises earlier this year by Warwick District Council’s food safety team.

The court heard that despite the intervention of the council’s food safety officers, the advice given to Mr Miah on making improvements and taking corrective measures had been ignored. On sentencing the Judge said that customers to the restaurant would have been appalled if they had seen the squalid conditions of the kitchen, dry store and cellar.

As well as being prohibited from involvement in the management of any food business, Mr Miah was sentenced to ten months in prison suspended for two years, ordered to do 150 hours of unpaid work and pay £500 costs.

Warwick District’s Portfolio Holder for Health and Community Protection, Councillor Andrew Thompson commented: "Warwick District Council works with food businesses to encourage high standards and protect the public. A vast majority of food businesses in the district are doing a great job with over 75% scoring the top ‘5’ food hygiene rating. We will always take enforcement action against businesses that fail to comply with the standards required of them and put the health of the public at risk."
