A local search reveals any restriction on a particular piece of land to limit the use to which the land may be put or to secure payment of a sum of money and is binding on successive owners or occupiers of the land.
A local (land charges) search carried out through the departments of the local authority is backed up by original source documents. The Land Charges Register is updated on a regular basis and expired items taken off. All land charges staff are trained in house and acquire a great deal of knowledge which they call upon when completing a local search. There are technical officers at hand to deal with any problems which might arise. The value of having a fully authenticated accurate search cannot be under estimated. Please use the expertise of your local authority.
There will be future benefit to the local housing market when the land charges system becomes fully electronic - we are working towards this goal.
What does a local search contain?
A local search is in two parts. The LLC1 and the CON29 forms. The LLC1 relates to all subsisting local land charges e.g.. Planning Applications from 1974: Tree preservation orders: Listed Buildings: Conservation areas: Smoke control orders: etc.
The CON29R form answers standard questions on planning and building regulations, highways matters, outstanding notices, conservation areas, contaminated land, etc.
The CON29O form covers 19 optional enquiries including e.g. public paths and byways, food safety notices, common land.
To submit a search please send the appropriate forms in duplicate by post or DX together with

An accurate full postal address, with two A4 location plans clearly outlining the property.

The full return postal or DX address in the box provided on the form LLC1.

The correct fee in the form of a cheque made payable to Warwick District Council.
Alternatively you may submit an electronic search via the National Land Information Service Hub (NLIS). Warwick District Council is currently at level 2 which means we can receive electronic searches but will return them by first class post or by the DX system. If you wish to use this service you will need to make arrangements with an NLIS Channel Provider for the submission of your searches.
All searches are returned by DX or first class mail.
Land Charges forms are normally provided by the solicitor dealing with your conveyancing. However if you require Land Charges forms (LLC1, CON29R or CON29O) these can be obtained from national suppliers such as Shaw and Sons Limited, or Oyez Straker.

Regulation
Under Statutory 2008 No. 3248 The Local Authorities (England) (Charges for Property Searches) Regulation 2008 the Council must now publish certain information after the end of the financial year. This must be approved by the Section 151 Officer. The Council has decided to include this information in the Statement of Accounts as well as publish on the internet
