High Court decision on Coventry Airport



The Council has been informed of the High Court’s decision dismissing Coventry Airport’s appeal into a new passenger terminal.

The Council is satisfied with the decision, but have yet to receive a full copy of the judgement.

The case arose as a result of The Secretaries of State for Transport and Communities ‘conjoined’ decision rejecting the Airport’s appeal into their original application for the larger passenger terminal. Following the Airport’s decision to appeal directly to the Secretaries of State in 2004, the application was not determined by Warwick District Council’s Planning Committee.

Commenting on the decision, Councillor Bertie MacKay, (Ind.) Chairman of Planning Committee and local Stoneleigh resident said: "I am pleased that the High Court have dismissed this appeal, and refused the Airport leave to appeal further. However, the Airport’s legal team have indicated their intention to exercise their right of appeal to the Court of Appeal, and they have 28 days in which to do this. It is too early to say the case is closed, but I am optimistic of a final outcome favouring local residents opposed to the expansion."
