Licensing policy statement of principles

Following a period of consultation Warwick District Council at a meeting held on 29 November 2006 approved for publication a Licensing Policy under the Gambling Act 2005 in the form of a Statement of Principles.

In accordance with the provisions of the Gambling Act 2005 (Licensing Authority Policy Statement) (England and Wales) Regulations 2006 notice is hereby given that Warwick District Council will publish its Licensing Policy Statement on 18 December 2006 and it will come into effect on 1 January 2007.

New regime guidance

On 1st September 2007 the Government introduced the provisions of the Gambling Act 2005. Warwick District Council, acting as the Licensing Authority, has become responsible for the implementation and administration of certain parts of the Act.

Under the new regime, there are three types of licences available; premises licences, personal licences and operating licences.

The Licensing Authority is responsible for issuing premises licences for casinos, betting shops, bingo halls, adult gaming centres and family entertainment centres and the Gambling Commission is responsible for issuing personal and operating licences.

Permits are also be issued by the Council to authorise the use of certain gaming machines in premises, including members clubs. There have been some changes as the types of categories of and only certain categories are allowed in certain premises.

The Council at present has a policy of not issuing permits for premises such as shops, supermarkets, cafes and takeaways. Under the new legislation there is no provision which enables gaming machines to be provided on premises of this nature. The policy will not therefore have to be confirmed under the new Act.

Small Lotteries are not unduly affected by the legislation, as the new rules governing them remain similar. The change over to the new registration system was made automatically on 1 September 2007. No action is required on the part of societies already registered with the Council.
