A 'sex establishment' can either be a Sex Shop, a Sex Cinema ' or a Sexual Entertainment Venue'.
A 'Sex Shop' is any premises used for business which consists to a significant degree of selling sex articles
A 'Sex Cinema' is any premises used to a significant degree for the showing of films which are concerned primarily with, or relate to, or are intended to stimulate sexual activity.
A ‘Sexual Entertainment Venue’ is any premises at which relevant entertainment is provided before a live audience for the financial gain of the organiser or the entertainer.
Relevant entertainment means any live performance; or any live display of nudity which is of such a nature that, ignoring financial gain, it must reasonably be assumed to be provided solely or principally for the purpose of sexually stimulating any member of the audience (whether by verbal or other means).
Licensed venues
There is, at present, one Sexual Entertainment Venues licensed by Warwick District Council.

Objections
Anyone objecting to the grant or renewal of a licence may only do so on the grounds of suitability for the locality in relation to other premises. Positive representations for the granting of a licence may also be made in the same way. Morality and religious grounds may not be used. Download an objection form (19kb, PDF).

Applications
Sex Establishments are required to be licensed under the Local Government (Miscellaneous Provisions) Act 1982.
The law defines the way in which an application is made. This includes the applicant advertising the application in the local press and displaying a notice outside the premises for 21 days in order to allow anyone the opportunity to comment. The date, in this case, is 28 days from the date the application was submitted to the Local Authority.
Tacit consent does not apply to this licence. This means that the licence will not automatically be granted within a certain timeframe. However, it is in the public interest that the application is processed as quickly as possible, so if you do not hear from us within a reasonable time, please contact us on licensing@warwickdc.gov.uk or telephone on 01926 456113.
